1. ACCEPTANCE OF TERMS

By accessing the website dennery.fm or downloading/using the Dennery FM mobile application (collectively, the “Service”), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, you must immediately cease all use of the Service.

2. ELIGIBILITY

You must be at least 13 years of age (or 16 in certain EU member states) to use this Service. By using Dennery FM, you represent and warrant that you have the right, authority, and capacity to enter into this agreement.

3. INTELLECTUAL PROPERTY RIGHTS

A. Our Content

All audio streams, music, podcasts, text, graphics, logos, and software used in the Service are the property of Dennery FM, its licensors, or content providers and are protected by international copyright, trademark, and intellectual property laws.

B. Limited License

We grant you a personal, non-exclusive, non-transferable, and revocable license to access and use the Service for personal, non-commercial entertainment purposes only.

C. Prohibited Actions

You are strictly prohibited from:

  • Recording, “ripping,” or capturing the audio streams for any purpose.

  • Redistributing, rebroadcasting, or performing the audio in public (e.g., in bars, restaurants, or retail stores) without a commercial license.

  • Using any “robot,” “spider,” or automated tool to access the Service for data mining.

  • Circumventing geographical restrictions (geofencing) used to comply with music licensing.

4. USER-GENERATED CONTENT (CHATS & COMMENTS)

If the Service allows you to post comments, shout-outs, or messages:

  • License to Us: You grant Dennery FM a perpetual, worldwide, royalty-free license to use, reproduce, and broadcast your content.

  • Conduct: You may not post content that is defamatory, obscene, hateful, or violates the privacy of others.

  • Monitoring: We reserve the right (but not the obligation) to monitor and remove any content that violates these terms or is deemed inappropriate.

5. MOBILE APPLICATION TERMS

A. Connectivity & Data

The Dennery FM app requires an internet connection. You acknowledge that your mobile carrier’s standard data rates and fees apply. We are not responsible for any data overage charges.

B. App Store Terms

If you downloaded the app via the Apple App Store or Google Play Store, you acknowledge that this agreement is between you and Dennery FM only, and not with the app store provider.

C. Updates

We may automatically push updates to the app to improve performance. Failure to install updates may result in the Service becoming unavailable.

6. COPYRIGHT COMPLIANCE (DMCA & EUCD)

If you are a copyright owner and believe that any content on Dennery FM infringes your rights, please contact our designated agent:

  • Subject Line: “Copyright Infringement Notice”

  • Requirements: You must provide a description of the work, the URL of the infringing content, and your contact information.

7. DISCLAIMER OF WARRANTIES

DENNERY FM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

  • The continuity or availability of the audio stream.

  • The accuracy of information (song titles, artist names) displayed.

  • The absence of viruses or other harmful components.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law (including the laws of the EU), Dennery FM, its affiliates, and its directors shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Service, including loss of data or hardware damage.

9. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Dennery FM from any claims, liabilities, damages, and expenses (including legal fees) arising from your breach of these Terms or your violation of any third-party rights (including music copyright).

10. TERMINATION

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.
